Permanent Holiday Lighting Terms of Service & Installation Agreement

Permanent Lighting Installation Services
By signing an estimate, invoice, or service agreement with Inverness Christmas Lighting LLC, the customer agrees to the following terms and conditions.
1. Product Warranty
Inverness Christmas Lighting LLC installs Omni permanent lighting systems.
The lighting system includes a manufacturer lifetime warranty on parts only.
The manufacturer warranty covers defective components including lighting modules and system components under normal use.
The warranty does not cover labor costs associated with diagnosing or replacing parts after the 1 year labor warranty period has expired.
The warranty does not cover damage caused by:
Acts of God including hurricanes, lightning, storms, flooding, or natural disasters
Power surges or electrical issues
Physical damage to the lighting system
Modifications or alterations to the system
Damage caused by third parties
Improper use or misuse of the system
Replacement parts will be provided according to manufacturer policies.
2. Labor Warranty
Inverness Christmas Lighting LLC provides a one (1) year labor warranty from the date of installation.
During this period, labor related to installation defects will be performed at no additional charge.
After the one-year labor warranty period, service visits will incur a $150 service fee, which includes the first hour of labor. Additional labor may be billed at standard service rates.
3. Lift Use & Possible Property Damage
Installation of permanent lighting may require the use of ladders, lifts, or other equipment.
While every effort is made to prevent damage during installation, the customer acknowledges that minor scuffs or marks from ladder or lift use may occur and are not considered damage.
Inverness Christmas Lighting LLC is not liable for damage to roofing, gutters, siding, landscaping, or other property surfaces resulting from normal installation procedures or equipment use.
4. Insurance
Inverness Christmas Lighting LLC maintains general liability insurance coverage for installation services.
Proof of insurance may be provided upon request.
5. Electrical Power Requirements
Permanent lighting systems require a functioning outdoor power source.
The customer asserts that a working outdoor electrical outlet is available and accessible for the lighting system.
The customer is responsible for ensuring that adequate electrical power is available.
If electrical modifications or installation of new outlets are required, additional charges may apply and may require a licensed electrician.
6. WiFi Requirements
The Omni lighting system requires a stable 2.4 GHz WiFi network for full functionality.
The customer is responsible for ensuring adequate WiFi signal strength at the controller location.
If the installation requires additional equipment such as a WiFi extender or booster, additional charges may apply.
Inverness Christmas Lighting LLC is not responsible for network connectivity issues caused by the customer’s internet service, router configuration, or signal strength limitations.
7. Design Approval
The lighting system layout, track color, and installation specifications are detailed within the customer’s estimate or invoice.
By signing the agreement or approving the estimate, the customer approves the design, layout, and track color specified in the proposal.
Any design changes requested after approval may result in additional charges.
8. HOA, Property Management, and Municipal Approvals
Some communities, homeowners associations (HOAs), or municipalities may have regulations regarding permanent exterior lighting.
By signing the agreement, the customer asserts that they have obtained all required approvals and that installation of permanent lighting is permitted on the property.
Inverness Christmas Lighting LLC is not responsible for HOA violations, fines, or removal requirements resulting from installation.
9. Maintenance & Care
To maintain warranty coverage and system integrity, the customer agrees not to:
Paint the lighting track or components
Cut or alter installed wiring
Remove or tamper with the controller
Install third-party lighting components into the system
Improper modifications may void warranty coverage.
Optional annual service plans may be available for routine system inspections and maintenance.
10. Customer Training
Installation includes up to one (1) hour of training on the use of the lighting system and mobile application.
Additional training requests beyond the included session may incur additional service fees.
11. Cancellation Policy
Customers may cancel installation services after signing the agreement.
However, deposits become non-refundable once materials or products have been ordered for the project.
12. Deposit & Payment Terms
A 50% deposit is required to secure installation and order materials.
The remaining balance is due prior to installation.
By signing the agreement, the customer authorizes Inverness Christmas Lighting LLC to automatically draft the remaining balance prior to installation using the payment method on file.
Accepted payment methods include:
Credit Cards
ACH Transfers
Cash
13. Weather & Installation Delays
Installation schedules may change due to:
Weather conditions
Safety concerns
Equipment availability
Material delays
Inverness Christmas Lighting LLC reserves the right to reschedule installation when necessary to ensure safety and quality of work.
14. Property Access
The customer agrees to provide safe and unobstructed access to the property for installation.
This includes:
Clearing driveways and work areas
Securing pets
Providing access to electrical outlets
Failure to provide access may result in rescheduling and additional service charges.
15. Photos & Marketing Rights
The customer grants Inverness Christmas Lighting LLC permission to photograph and record images of the completed installation.
These images may be used for:
Marketing materials
Social media
Website content
Advertising
No personal identifying information will be shared without consent.
16. Warranty Limitations
Warranty coverage may be void if:
Installed wiring or components are cut or altered after installation
Third-party lights, transformers, or components are added to the system by the client
Unauthorized repairs or modifications are performed
17. Limitation of Liability
Inverness Christmas Lighting LLC shall not be liable for indirect, incidental, or consequential damages, including but not limited to property damage, electrical damage, or loss of use resulting from installation or use of the lighting system.
The company’s maximum liability shall not exceed the total amount paid for the installation service.
18. Acts of God
Damage caused by natural events including but not limited to:
Hurricanes
Lightning
Flooding
Severe storms
Fire
are not covered under warranty or service agreements.
19. Governing Law
This agreement shall be governed by and interpreted according to the laws of the State of Florida.
Seasonal Lighting Terms of Service

1. Introduction
Welcome to Inverness Christmas Lighting, LLC (“Company,” “we,” “our,” or “us”).
These Terms of Service (“Terms”) govern all quotes, services, and installations performed by Inverness Christmas Lighting, LLC, including through our websites lightinginverness.com and invernesschristmaslighting.com.
By requesting a quote, making a payment, or allowing us to perform installation, you (“Client,” “you,” or “your”) agree to these Terms in full.
2. Scope of Services
Our Christmas lighting service includes:
Providing and installing commercial-grade holiday lighting and décor
Maintaining installed lighting and décor throughout the holiday season
Removing all lighting and décor after the season
Storing Company-provided lighting for use in the following year
All installations are performed by trained technicians to ensure safety and quality.
3. Use of Company-Provided Lights
We exclusively use our commercial-grade lighting and décor designed for professional installation.
If a customer requests that we install customer-provided lights, decorations, or materials, the following conditions apply:
We may decline to install customer-supplied items at our discretion.
Any installation using customer-provided materials voids all warranties, including the season-long maintenance guarantee.
The Company assumes no responsibility or liability for defects, failures, or safety issues arising from customer-provided products.
4. Deposits and Payments
A 50% deposit is required to secure your spot on our installation schedule.
The remaining balance is due before installation begins.
Payments can be made online or in person through approved payment methods listed on our website.
All deposits are non-refundable once materials have been allocated or scheduled.
Failure to pay the remaining balance before installation may result in delays or cancellation of service.
5. Warranty and Maintenance
When using Company-provided lighting, Inverness Christmas Lighting, LLC guarantees:
Season-long maintenance at no additional charge for standard wear, light outages, or connection issues.
Maintenance does not cover damage caused by misuse, pets, weather beyond normal seasonal conditions, vandalism, or interference by others.
If maintenance is requested and the issue is caused by customer actions, a service fee may apply.
Warranty and maintenance coverage end automatically once lighting is removed at the end of the season.
6. Scheduling and Installation
Installations are scheduled on a first-come, first-served basis once the deposit is received.
Weather conditions or unforeseen delays may affect your scheduled date; we will notify you promptly of any changes.
You agree to provide safe and reasonable access to the installation area, including access to necessary power sources.
7. Removal and Storage
After the holiday season, we will remove all lighting and décor and store Company-owned products for the next year.
Storage is included in the service package. Customer-provided products, if used, are not stored by the Company unless otherwise agreed in writing.
8. Property Access and Safety
By scheduling installation, you grant us permission to access your property for setup, maintenance, and removal.
We will take all reasonable precautions to prevent damage; however, Inverness Christmas Lighting, LLC is not responsible for pre-existing conditions, loose materials, or electrical issues unrelated to our installation.
9. Cancellations and Refunds
If you need to cancel before installation:
Cancellations made before materials are ordered may receive a refund of the deposit, less administrative fees.
Once materials are allocated or the job is scheduled, deposits are non-refundable.
Cancellations made after installation has begun will be charged in full.
10. Limitation of Liability
To the fullest extent permitted by Florida law, Inverness Christmas Lighting, LLC is not liable for:
Indirect, incidental, or consequential damages
Damage caused by weather, animals, vandalism, or interference
Customer-provided equipment or electrical supply issues
Our total liability shall not exceed the total amount paid by the customer for the specific season’s service.
11. Intellectual Property
All photos, videos, and marketing materials of our lighting displays remain the property of Inverness Christmas Lighting, LLC.
We may use general images of our work for promotional purposes unless the client requests otherwise in writing.
12. Governing Law
These Terms are governed by the laws of the State of Florida. Any disputes shall be resolved in Citrus County, Florida.
13. Modifications to Terms
We may update these Terms at any time by posting a revised version on our website. The updated Terms apply to all future services after posting.
